Return Agreement for Business Customers

1. Scope

This return agreement applies to all purchase contracts for goods, in particular forklift trucks, concluded between HELI Gabelstapler (hereinafter the ‘Seller’) and entrepreneurs within the meaning of § 14 BGB. There is no statutory right of withdrawal or return.

2. Exclusion of Returns

The return of delivered goods is generally excluded. Goods will be taken back only with the Seller’s prior written consent and as a voluntary gesture of goodwill.

3. Conditions for an Approved Return

• The goods are in their original, unused and unaltered condition.
• There is no damage, wear or evidence of use.
• The goods are returned complete, including accessories and original packaging.
• The goods are returned carriage paid to the place of performance specified by the Seller.
• The Buyer bears all costs and risks associated with the return.

Individually configured, specially manufactured or customer-specific goods are excluded from return.

4. Damages in the Event of Return or Non-performance

If the Seller is entitled to claim damages in connection with an approved return or due to non-performance of the contract, the following provision applies:

The lump-sum damages amount to 30 % of the agreed net purchase price unless a higher or lower loss is demonstrated.

The amount of damages will be higher or lower if the Seller demonstrates a higher loss or the Buyer demonstrates a lower loss.

5. Return Procedure

1. Written return request by email to info@heli-stapler.eu, quoting the order or invoice number.
2. Written approval or rejection by the Seller.
3. Return of the goods within the approved period.
4. Inspection of the goods after receipt.

6. Refunds and Time Limits

Following receipt and final inspection of the goods, the refund will be processed within 14 calendar days.

The refund will primarily be offset against outstanding or future claims. Payment by bank transfer or in cash will be made only if this has been expressly agreed in writing.

Services already performed and transport, assembly or disassembly costs are excluded from the refund.

7. Final Provisions

German law applies exclusively. To the extent permitted by law, the place of jurisdiction is the Seller’s registered office. The applicable General Terms and Conditions of HELI Gabelstapler are authoritative.
